General terms and conditions of business
1. Delivery and sales information
Deliveries are made within the scope of available resources. Failure to meet stipulated delivery times does not give rise to any claims for damages. We reserve the right to make partial deliveries. The prices valid on the day of delivery will apply. Goods are shipped uninsured from the manufacturer at the buyer's risk and expense. Packaging material is free of charge.
2. Shipping
Shipping will be via the most economical method available to us. Any claims for transport damage must be submitted directly to the responsible transport company.
3. Complaints regarding quantity
Any discrepancies in quantity must be immediately noted and documented by the transport company's warehouse driver. Later claims cannot be accepted.
4. Packaging
It will be carried out to the best of our knowledge and in accordance with standard commercial practices. We are not liable for any damage that may occur during transport, including damage to the packaging.
5. Returns or partial returns
Returns or partial returns require our prior approval and can only be considered within six months of the delivery date. Credit notes are only issued for new or undelivered goods returned postage paid to our factory (St. Roman, Austria). Custom-made items are generally non-returnable.
6. Payment
The first delivery to a new customer will only be made with prepayment or cash payment upon collection.
7. Payment default
In case of late payment, the buyer shall bear the bank's standard interest and expenses for the loan. Extensions of bills of exchange, including partial extensions, are generally not permitted. Likewise, in cases of imminent danger, all amounts that would otherwise be payable at a later date according to the agreed terms shall become immediately due and payable.
8. Property rights
All delivered goods remain our property until the purchase price has been paid in full. Claims arising from resold goods are assigned to us up to the amount of the original invoice. Withholding or offsetting payments due to any counterclaims by the customer is not permitted.
9. Place of performance and jurisdiction
The place of performance and jurisdiction for delivery and payment, including in the case of payment by bill of exchange, is Schärding. For foreign customers, the supplier may also specify their place of residence. For minors or non-merchants, Schärding is agreed as the place of jurisdiction for debt collection proceedings and in the event that the buyer's whereabouts are unknown at the time the action is filed, or if their residence or habitual abode is abroad.
10. Purchase conditions of the buyer
Any terms and conditions of purchase of the customer that contradict these conditions will not be recognized by us under any circumstances, even if the customer is not separately notified accordingly.
11. Technological progress
We reserve the right to make changes that serve technical progress.
12. Right of withdrawal
You can cancel your order without giving reasons within 14 days of the contract becoming effective by sending written notice (e.g., letter, fax, email) or by returning the goods. The cancellation period begins no earlier than the date the contract becomes effective. To meet the cancellation deadline, it is sufficient to send the cancellation notice or the goods before the deadline expires.
In the event of a valid cancellation, the purchase agreement becomes void. Both parties are obligated to return any goods or services received and to surrender any benefits derived from their use (e.g., usage advantages). If you are unable to return the received goods in whole or in part, or only in a deteriorated condition, you may be required to compensate us for the diminished value. This does not apply if the deterioration of the goods is solely due to their inspection, such as would have been possible in a retail store. You can avoid the obligation to compensate for diminished value by not using the goods as if they were your own property and by refraining from any actions that impair their value.
You are responsible for the return shipping costs if the delivered goods match your order and if the price of the returned goods does not exceed EUR 40.00, or if, in the case of a higher price, you have not yet paid the full purchase price or a contractually agreed partial payment at the time of cancellation. Otherwise, the return is free of charge for you.
